Our Policy & Safe Harbor

218 Marketplace is an online venue connecting independent vendors with shoppers — we do not manufacture or own the goods listed, and vendors retain ownership of their designs and media. We respect intellectual property rights and respond to properly submitted notices under the Digital Millennium Copyright Act (17 U.S.C. § 512). When we receive a valid takedown notice, we will promptly remove or disable access to the identified material and notify the vendor whose listing was removed.

Filing a Takedown Notice

To be effective under the DMCA, your written notice must include all of the following:

  • Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered;
  • Identification of the material you claim is infringing, including enough information (e.g., the listing URL) for us to locate it;
  • Your contact information, including full legal name, mailing address, telephone number, and email address;
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement that the information in your notice is accurate and that, under penalty of perjury, you are the copyright owner or authorized to act on the owner's behalf;
  • Your physical or electronic signature.

Knowingly submitting a false or materially misleading notice may make you liable for damages, including costs and attorneys' fees, under Section 512(f) of the DMCA.

Counter-Notification

A vendor whose listing is removed may submit a counter-notice to the designated agent above, including their contact information, identification of the removed material and its former location, a statement under penalty of perjury that the material was removed by mistake or misidentification, and their consent to the jurisdiction of a federal court. If we receive a valid counter-notice, the original complainant has 10–14 business days to file a court action; otherwise the removed material may be restored.

Repeat Infringers

It is our policy, in appropriate circumstances, to disable the storefronts and terminate the accounts of vendors who are deemed repeat infringers of others' intellectual property rights.

For context on prohibited goods (including trademark-infringing merchandise and unlicensed characters or logos), see the Vendor Agreement and our Terms of Service.
