Terms of Service

The terms that govern shopping on 218 Marketplace. Effective date: October 20, 2026.

218 Marketplace is a multi-vendor venue connecting shoppers with independent makers across Northern Minnesota. These terms apply to everyone who browses or buys on the marketplace.

1. Our Role: A Venue, Not a Seller

  • 218 Marketplace is an online venue that connects shoppers with independent vendors — artisans, makers, and resellers based in Northern Minnesota.
  • We are not the manufacturer, importer, seller of record, or direct provider of the goods listed on the marketplace. Each purchase forms a contract of sale between you and the vendor, and the vendor is the seller of record for that transaction.
  • Vendors are solely responsible for producing, accurately describing, packing, and fulfilling the items they list, including any workmanship, sourcing, or labeling claims.
  • Sellers verified with ID & licensing attestations: every seller must attest to their identity and, where required by law, to holding the licenses, permits, and insurance their listings demand; these attestations are enforceable under the Vendor Terms, and 218 Marketplace may review, remove, or suspend any storefront or listing that falls short of them.

2. Accounts & Acceptable Conduct

  • You agree to provide accurate account information, keep your credentials secure, and use the marketplace only for lawful purposes.
  • You may not interfere with the operation of the marketplace, scrape or harvest other users' data, circumvent checkout, or direct vendors or buyers to off-platform payment methods.

3. Purchases, Payments & Taxes

  • Payments are processed securely by Base44 Payments. Product prices, shipping rates, and return policies are set by each independent vendor; shipping quotes come from live carrier rates based on your delivery ZIP.
  • At checkout you pay the item prices set by each vendor, plus three separately itemized charges: shipping (a live carrier quote per vendor), Minnesota sales tax on taxable items, and a payment-processing fee of 2.9% of the order subtotal plus $0.30 per order. Each charge is shown as its own line before you place your order, and none of them goes to the vendor.
  • 218 Marketplace operates as a Marketplace Facilitator and calculates, collects, and remits Minnesota state and local sales tax on eligible transactions, as required by Minnesota law.

4. Second-Hand & Vintage Items

  • Second-hand, resale, and vintage items are sold as-is by independent sellers. Conditions are self-reported by the vendor (like new, good, fair), and we encourage you to review the listing description and photos carefully before purchasing.
  • Every vendor selling second-hand goods certifies that their items are legally owned, authentic, and compliant with consumer product safety standards — recalled items are banned from the marketplace.
  • Because these goods are pre-owned, we disclaim liability for defects, undisclosed wear, or fitness for a particular purpose that are not apparent from the vendor's listing.

5. Banned Items & Conduct

  • The following are prohibited on the marketplace: illegal items and controlled substances; firearms, explosives, and hazardous materials; counterfeit or trademark-infringing goods; dangerous services; AI-generated or AI-produced goods of any kind (artwork, writing, music, video, print-on-demand designs, prompt packs, or other digital assets made with AI tools); and hate-based or harassing content.
  • Unsafe second-hand items are also banned — including recalled products (such as recalled baby gear, car seats, cribs, or electronics) and items that fail required safety standards. Listings that violate these rules may be removed, and the responsible vendor's storefront may be suspended.

6. Liability Disclaimers

  • The marketplace is provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, 218 Marketplace disclaims liability for: defective second-hand items; misrepresented, damaged, or non-conforming vendor goods; and unsatisfactory vendor work or fulfillment.
  • Your remedy for problems with an item lies first with the vendor that sold it. The platform may, at its discretion, facilitate refunds or charge back a vendor's payout balance under the dispute process in the Vendor Agreement.
  • In no event shall the platform be liable for indirect, incidental, or consequential damages arising from transactions between buyers and vendors.

7. Returns & Disputes

  • Contact the vendor first with any issue — vendors agree to respond within 24–48 business hours. The default platform policy grants you 14 days from delivery to request a return for damaged or defective items, though each vendor's storefront policy governs their shop.
  • If a vendor fails to resolve an unfulfilled or defective order dispute within 5 business days, 218 Marketplace may issue a refund to you directly.

8. Changes & Contact

  • If we update these terms, we will post the new version on this page with a new effective date.
